Terms & Conditions

These Terms & Conditions govern all art commissions requested from Kayla Brown. By submitting a commission request or making payment, clients agree to the following terms.

Commission Details
Before work begins, the scope will be confirmed in writing, including:

  • Subject, style, and composition

  • Size and format (digital or traditional)

  • Timeline and delivery date (if applicable)

  • Final pricing and payment terms

Changes outside the agreed scope may be treated as additional work or a new commission.

Content Guidelines & Right to Decline

  • No NSFW or sexually suggestive artwork (explicit nudity, fetish content, sexual acts, erotic themes)

  • No hateful, discriminatory, or off-brand commissions

  • The artist may decline/cancel any commission at any time, for any reason

  • No work started = full refund | Work started = see Cancellations & Refunds

Payment Terms

  • Non-refundable deposit of at least 50% required before work begins

  • Remaining balance due upon completion, before delivery

  • Accepted payment methods listed on the invoice

  • Late payments (7 days past completion) may result in cancellation (deposit retained)

Revisions Policy

  • Two (2) complimentary revisions included (sketch + early color stages)

  • Minor adjustments only (pose, colors, small details)

  • Major changes (new concepts, subjects, style) not included

  • Additional revisions beyond two = extra fee (quoted before continuing)

  • Major changes after sketch approval = new commission

Timeline & Communication

  • Estimated timelines provided, but subject to change

  • Clients must respond within 5 business days

  • Extended delays may pause/cancel the project (deposit non-refundable)

Cancellations & Refunds

  • Before work begins: Refund minus non-recoverable fees (artist's discretion)

  • After work begins: Deposit non-refundable; additional refunds based on work completed

  • Artist cancellation (non-violation): Full refund

  • Artist cancellation (terms violation): Deposit + fair compensation retained

Delivery

  • Digital: Email/download link (JPG, PNG, PDF, etc.)

  • Physical: Client is responsible for shipping/packaging/insurance

  • The artist is not liable for carrier damage/loss

Copyright & Usage Rights
Artist retains full copyright. Clients receive:

  • Personal use license only

  • ✅ Home/office display

  • ✅ Online sharing with artist credit

  • ❌ No resale, products, commercial use, branding

  • ❌ No signature removal or authorship claims

Commercial use requires a separate agreement + fee.

AI, NFTs, & Derivatives

  • No AI training, AI derivatives, or NFT/blockchain use without written permission

Reference Images & Privacy

  • Clients confirm rights to reference images (or used as inspiration only)

  • Personal info used only for commission fulfillment/record-keeping

Terms Updates
The version active at the time of deposit payment governs each commission.

Acceptance
Submitting a request, paying a deposit, or providing written confirmation = agreement to these terms.
